However, New Jersey courts will resume issuing writs of possession for commercial foreclosures effective February 15, 2021.
Landlords can apply for an Order to Show Cause for eviction in certain circumstances deemed an emergency, including criminal activity, damage to the building, death of a tenant, or permanent closure of the business resulting in vacancy. Eviction cannot be pursued on the basis of nonpayment of rent unless the business is vacant, or not operating and will not resume.
Evictions for residential tenants will not proceed until Spring 2021 at the earliest.
